Privacy
Engage Western NSW Health is owned and operated by Western NSW Local Health District (WNSWLHD) using software licensed from Social Pinpoint. For details on how WNSWLHD collects and protects your personal information, refer to their Privacy Statement below. Your privacy is important to us. This Privacy Statement describes how we collect, use, store and disclose personal information when you interact with Engage Western NSW Health.
When used in the Statement, "personal information" has the meaning given in the NSW Privacy Acts. Generally, it means any information or an opinion that could be used to identify you.
Privacy and using this site
Engage Western NSW Health was created for people to engage with WNSWLHD, share their ideas and tell us what is important to them as we plan and design services.
WNSWLHD takes the privacy of those using this site very seriously. We adhere to the privacy standards outlined by NSW Government Privacy Statement.
WNSWLHD Privacy Statement applies to the Engage Western NSW Health site specifically and provides details on how it collects and protects your personal information as part of your use of this site. This privacy statement does not apply to any other aspects of your interactions with WNSWLHD (eg receiving a health service).
The personal information gathered through your interaction with Engage Western NSW Health is only for the purpose of your participation in this site and the consultations listed.
By providing personal information and/ or continuing to use Engage Western NSW Health you consent to your personal information being collected, used and disclosed in accordance with the Privacy Statement and you also agree to Engage Western NSW Health Terms of Use, and Moderation and Community Guidelines.
How is your privacy protected?
An individual's right to privacy as established under the Privacy and Personal Information Protection Act 1998 and the Health Records and Information Privacy Act 2002 is respected and observed by WNSWLHD.
WNSWLHD does not allow the publication of information that may identify individuals or might potentially identify them. Any statistical data that is used is publicly available information.
Links to external (non-WNSWLHD) sites are sometimes included in information for the convenience of site users, but WNSWLHD does not have any responsibility for the privacy practices of third party sites.
What information do we collect?
We collect information about you and your used of Engage Western NSW Health. The type of information we collect will vary depending on how you interact with the service. We will only collect personal information if it is necessary to carry out the functions of Engage Western NSW Health. We will always take reasonable steps to collect your personal information directly from you and provide you with options about what information you share.
Site visitor data
Engage Western NSW Health collects information for statistical and system administration purposes. This includes
- the day and time you visited this site
- your route throught Engage Western NSW Health (the sequence of pages and other content that you visit)
- any documents, images or videos that you download from the services
- your rough geographic location
- your server (or IP) address.
If you register to join the community network we ill collect the above data and also
- your name, email address, username
- information about your preferences and interests.
WNSWLHD will not attempt to identify individuals from the records the server automatically generates unless necessary to investigate a breach of law or regulation.
Cookies
Cookies are used on our site, but they do not collect any personal information. for the most part they just contain system-generated values to identify the user's session for statistical and system administration purposes only.
We collect the data and information through a combination of Google Analytics, server logs and tools within the functionality of the site, using data security protocols.
Registration
Some consultations may require you to be registered to take part.
To register you need to provide your
- username (visible to others when you make comment or post on project pages)
- password
- email address.
Optional registration information may include:
- demographic information (age, location)
- topics about which have indicated an interest in being consulted or informed
- contact preferences and subscription to other (optional) communications from us.
To protect your own privacy, your password for Engage Western NSW Health should be kept confidential, and must not be displayed, shared or written down.
Participation in a consultation
Consultations on Engage Western NSW Health are conducted by staff from WNSWLHD and supported by the WNSWLHD Community Engagement Team.
We collect information that you provide via the feedback tools used with the consultations. The tools may include:
- comments and votes in forums
- stories
- surveys
- interactive maps
- quick polls
- ideas and suggestions
- images.
Correspondence
Any feedback or correspondence that you send via the Engage Western NSW Health site, email, text or phone conversation will be stored in a secure area in accordance with the Privacy and Personal Information Protection Act 1998.
Moderation
To protect the safety of the community and ensure that the site is a safe space for all participants, comments submitted to the site are moderated by Social Pinpoint and the site administrators from WNSWLHD. Content deemed to be inappropriate, or offensive will be removed in line with Engage Western NSW Health Moderation and Community Guidelines.
How will we use your information?
We use the personal information about you to
- send you updates and information, but only when you have agreed to us sending you this information or when the information is necessary to assist with the administration of the site
- administer the site and manage your account
- identify when you sign into your account
- respond to queries that you have contacted us about
- attribute content that you post on the site to you
- analyse use of the site to inform ongoing improvements and enhancements
- inform policy decisions, service delivery or project development by WNSWLHD
- for any other purposes that we indicate to you when we request your personal information.
User feedback
The information you provide through the feedback tools will be collated and provided to the WNSWLHD team overseeing the project for the purpose of decision-making and development of the service or project. You will not be identified as part of this report, unless we advise otherwise. You will be identified if you are applying to part of a committee or workshop and it is necessary for the team to contact you to discuss your application.
Reports from consultations may also include de-identified quotes from participants in forums, surveys and other consultation tools.
Each consultation will provide you with the following information:
- the project that you are contributing to
- who is leading the project and their contact information
- how you can take part and provide your input
- what will happen to the information or feedback you provide
- important dates and stages of the project.
What information is publicly available?
Not all of the information that you provide to us can be viewed by other users of Engage Western NSW Health.
Publicly available information is limited to your username (selected by you) and any comments you leave under that name in the forums or other feedback tools on Engage Western NSW Health. We recommend you protect your privacy by selecting a username which does not identify you and that you do not include personal identifying information (eg real name, location) in you comments.
Reports of collated responses and statistics from consultations may be made publicly available or shared with third parties (eg contractors assisting with project development or relevant stakeholders). Any comments submitted by you included in the report will be de-identified. Statistics and collated feedback will not include any identifying information.
Information available to both WNSWLHD and Social Pinpoint
Information available includes
- all information from the sign-up form
- comments, questions, stories
- survey responses, quick poll responses, map pins
- general site activity such as document downloads, videos viewed, images viewed etc
- information on the technology used to access the site.
Hidden information
We will not disclose to other users of the site
- your password for Engage Western NSW Health
- any personal information provided by you in the course of consultations that you do not expressly provide permission to disclose
- correspondence that you send to us using Engage Western NSW Health contact information
- information that you submit to specific consultations within Engage Western NSW Health.
Storing and disclosing personal information
Personal information will be kept in safe custody, and will be properly handled to ensure its safety, integrity and confidentiality. Circumstances in which WNSWLHD may be required to disclose this information to a law enforcement agency include:
- unauthorised tampering or interference with files published on Engage Western NSW Health
- unauthorised attempts to access files which are not published on Engage Western NSW Health
- attempts to intercept messages of other users of Engage Western NSW Health
- communications which are defamatory, abusive, vilify individuals or give rise to a suspicion that an offence is being committed
- attempts to otherwise compromise the security of the web server or breach the laws of the State of NSW or the Commonwealth of Australia.
Data security and destruction
Under the NSW Privacy Acts, we have a responsibility to protect your personal information. We take reasonable steps to make sure that your personal information is protected from misuse, loss, and unauthorised access, modification or disclosure.
Further, any personal information that we collect and use for identifying user trends is aggregated and anonymised when generating reports.
When will we contact you?
We may send you information and announcements from time to time by email. If you give us permission, we may also call you on the phone number provided to discuss your application or feedback.
You can choose to receive communication and other updates from us by email. If you choose this but then change your mind, you can unsubscribe at any time by following the process set out in the emails and newsletters we send you.

Changes to our Privacy Statement
We may update the content of the Privacy Statement from time to time for any reason. The updated version of the Privacy Statement will apply to you as soon as it is posted on the website, so we suggest that you regularly review the Privacy Statement.
Terms of Use
The following Terms and Conditions govern the use of Engage Western NSW Health (“the site”). The software platform is owned by Social Pinpoint Pty Ltd and operated by us, Western NSW Local Health District.
By accessing and using this site, you are choosing to accept and comply with the Terms presented throughout this agreement as well as the Privacy Statement, and Moderation and Community Guidelines. These Terms apply to all visitors and users of this site. Linked sites, affiliated services or third party content or software have their own Terms that you must comply with. If you disagree with any of the Terms presented in this agreement, you may discontinue using the site immediately.
If you are under 14 years old, please ensure that your parent or guardian understands and accepts these Terms and Conditions (including the Privacy Statement, and Moderation and Community Guidelines).
Using this site
While using the site, you must not violate any applicable laws and regulations. It is our duty to protect the confidentiality of content you provide on our site in accordance with our Privacy Statement. When you create an account with us, you must always provide us with accurate information. Failure to provide accurate information violates the Terms, which may result in immediate termination of your account on our service. You are responsible for protecting your own password you use for this site and for any activities done under that password. Unauthorised use of your password or account must be immediately reported to us. In some cases, we or our agents may require access to your user accounts to respond to technical issues.
We are not responsible for the content on the site that has been provided by the users of the site. Any content posted by you is subject to the rules of our Moderation and Community Guidelines. What do we require from users of Engage Western NSW Health?
You must understand and agree that, without limitation:
- all information, data, images and other materials are the sole responsibility of the person from whom the content originated
- you are prohibited from advertising or offering to sell or buy any goods and services
- you cannot transmit Content that contains software viruses or programs designed to change or destroy the functionality of any computer software or hardware; or
- you cannot collect or store personal data about other users of the site
- you cannot impersonate any person or entity, including without limitation to our representative
- you cannot interrupt or interfere with the site or servers or networks connected to the site
- you cannot attempt to gain unauthorised access to the site or other use accounts.
Suspension or Termination of Access
We may terminate or suspend access to your site and/ or account immediately, without prior notice, including without limitation if you breach the Terms. We may immediately deactivate or delete your account and all the related files and information in your account. After your account has been terminated, the content you have posted may also remain indefinitely on the site.

Governing Law
These Terms shall be governed in accordance with the laws of New South Wales, Australia, without regards to its conflict of law provisions.
Indemnification
Western NSW Local Health District, its subsidiaries, affiliates, officers, agents, licensors and other partners are not responsible for any loss, liability, claim, or demand, including legal fees, made by any third party due to or arising from a breach of this agreement and/or any breach of your representations and warranties set forth above.
What content do we own?
Engage Western NSW Health contains the copyrighted material, trademarks, patents, trade secrets and other proprietary information (“Intellectual Property”) of Western NSW Local Health District and its suppliers and licensors. We own and retain all proprietary rights in the intellectual property. All intellectual property in the content of this site including without limitation to text, software, source code, pages, documents and online graphics, photographs, sounds, audio, video and other interactive features are owned by or licensed to us.
Any original content that you submit or post on our site may be made available to the public and allows users to share your content (with the end user acknowledging your contribution) under the Creative Commons Attribution-ShareAlike 4.0 Australian License.
Except for Intellectual Property which is in the public domain or for which you have been given written permission, you may not copy, alter, transmit, sell, distribute any of the Intellectual Property on this site.
We are not responsible for your communications or dealings with a third party found via our website. Any loss or damage incurred from those communications or dealings are solely between you and the third party.
Cancelling your registration
You can cancel your registration with Engage Western NSW Health at any time by emailing WNSWLHD-Community@health.nsw.gov.au.
Content that you have posted to Engage Western NSW Health may remain on the service even after you have cancelled your registration and may be included in reports as part of the consultation process.
Cancelling your subscription to Engage Western NSW Health communications
You can choose to receive communications from Engage Western NSW Health by email. If you then change your mind, you can unsubscribe at any time by following the process set out in the emails we send you or by altering the settings in your user profile.
Disclaimer and Warranties
Your use of the site is at your own risk. We make no warranty that the site will meet your requirements or be uninterrupted or error-free. Any material that the user downloads through the site is done at their own risk and are responsible for any damages to their computer system or loss of data.
What happens if these Terms change?
We reserve the right, at our sole discretion, to modify or replace these Terms at any time without notice. The most recent version of the Terms can be seen on this page. By continuing to access or use our site after those revisions become effective, you agree and will comply to the revised terms.
